Bowland Equine Therapy Terms and Conditions
1. Bowland Equine Therapy
Bowland Equine Therapy is operated by a partnership between Clare Guest and Philip Brewer. The place of business is Longmoor Farm, Ellel, Lancaster, LA2 0QD
2. Acceptance of these Terms and Conditions
These Terms & Conditions will apply to all bookings made with Bowland Equine Therapy. By making a booking with Bowland Equine Therapy you also agree to accept these Terms and Conditions.
If you are not the owner of the horse to be treated, by making a booking you confirm that you are authorised by the owner(s) to accept these Terms & Conditions on their behalf.
3. Payment, cancellations, refunds and use
Walk-in sessions:
- Discounted packages of sessions need to be paid for (and funds cleared) before the first session is taken. Bookings made as part of such a package are totally flexible and can be rescheduled at any time (subject to availability). Payment for packages can be made in advance by bank transfer, cheque or in person with cash.
- Discounted packages of sessions must be used up within 12 months of purchase. We don’t issue refunds for unused sessions purchased as part of a package.
- If you cancel or reschedule a one-off session without giving us 24 hours’ notice, we reserve the right to charge you in full for the session.
- If we need to re-schedule a session less than 24 hours before that session is due to start, we will offer you the choice of a re-schedule or a refund.
- Bookings are transferable between your horses, but not between you and another owner. Please let us know in advance the details of any horse you are going to bring for the first time.
Livery Packages
- Livery packages must be paid for prior to the horse being removed from the premises
4. Suitability of treatment
We make every effort to ensure the treatment is appropriate for the horse, but ultimate responsibility for this lies with you. If you have any uncertainty about your horse using any of our equipment then you should consult your vet first.
Where the horse has been referred by a vet, you agree that we may discuss the treatment with the vet.
5. Horse health, medical records and behaviour
If your horse has an infectious or contagious condition, you must not bring it to our site. If your horse develops such a condition during its course of treatment with us, you must inform us as soon as possible.
You must show us up-to-date vaccination records for your horse before its first session.
We ask that you inform us of any known vices/behavioural issues with the horse to be treated in advance. It is particularly important that you tell us if your horse is easily “spooked” so we can take measures to reduce the risk of an incident.
You must leave with us the passport of any horse staying on our premises overnight. This will be kept in a secure place and returned to you when you collect the horse.
6. On-site safety
For your, our and your horses’ safety, you must pay attention to on-site safety notices and instructions from us and comply with those notices and instructions.
By coming onto our site, you agree that you will take all reasonable precautions to ensure the Health and Safety of everybody on site. In particular, you agree to abide by the following site rules:
- Smoking is not permitted anywhere on our premises, inside or out
- We don’t allow Dogs to be loose anywhere on the site
- Horses must not be left tied to lorries/trailers in our yard
7. Non-provision of service
We reserve the right not to provide the service that has been booked if we feel to do so would put you, your horse, our staff, and/or premises and equipment at risk of injury or damage.
In such circumstances we will normally re-schedule the session for another time/date, however if we are unable to provide the service because you have not done something you have agreed to in these Terms and Conditions, we will treat it as a cancellation.
8. Use of photography/video and copyright
You agree that we may take photographs and video footage of your horse in our premises and you agree that the copyright in any such media will reside exclusively with us.
9. Limitation of our liability to you
You agree that you use our facilities at your own risk. Unless specifically caused by our negligence, we will not be liable to you in any way for any injury, accident, damage or illness to any person, property or animal, at our premises or anywhere else.
You agree to waive your rights of recourse against the insured in the event of a claim under the
Care, Custody or Control policy when the claim relates to an injury or illness for which the horse was placed with the Insured for rehabilitation.
10. Damage to premises and equipment
If your horse causes damage to our premises or equipment we reserve the right to charge the costs of making repairs (or, if necessary, replacement) to you.
In particular, you warrant to us that your horse is properly shod. We will conduct reasonable checks of your horse’s feet before commencing treatment but damage caused to equipment by broken/loose shoes or shoe fixings will be charged to you. We strongly advise you to check your insurance cover before your first session.
11. Warranty
The treatments we offer are therapeutic in nature and therefore we don’t make any guarantee as to their effectiveness.
12. Third Party Rights
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and us only.
- 13. Third PartyInsurance
You must ensure that your horse is insured for third party liability
